PURCHASING FIREARMS ONLINE

It is illegal to ship firearms to anyone not holding an active Federal Firearms License (FFL). For that reason, firearms purchased online may be picked up at our store or shipped to an FFL (gun store) near you. We may contact and verify the FFL you select during checkout before we ship your firearm(s). The buyer is encouraged to contact the receiving FFL licensee before purchase.

RETURNS

If you are not satisfied with your purchase, please contact us within 15 business days of purchase.

Sales on the following items are final:

Special orders.

Products sold "as is" or "used" or that have been installed or used after receipt.

NFA items.

Illumination devices, electronic sights and optics.

USED FIREARMS

Used firearms may not be returned. All sales are final. Description and photos (if available) are provided by the seller.

GENERAL FIREARM SALES

Please inspect the firearm before you proceed with the transfer, once the firearm is transferred to you the sale is final. If for any reason you need to cancel the order and the firearm has already shipped or you cannot take possession of the firearm and need to return the firearm, you will be responsible to pay for shipping back and a 25% restocking fee will be charged. All firearms, magazines, receivers and restricted law enforcement items are sold and shipped in accordance with all existing federal, state and local laws and regulations. Many of the firearms, magazines and parts for sale on this website may be restricted or prohibited in your area. Please check your local and state regulations before ordering. All new firearms are shipped in the original manufacturer's box, with magazine(s), accessories and applicable warranty. Firearms requiring warranty work must be returned to the factory within 1 year of purchase for repair. Accessories and special-order items not normally sold by our store will not be covered under warranty even if these products are part of an integrated firearms package, unless we have guaranteed the entire package in writing. Please contact the original manufacturer for warranty information on all accessories and special-order items.

SECURE TRANSMISSION

All information collected during the checkout process is transmitted via industry standard Transport Layer Security (TLS). A Transport Layer Security (TLS) Certificate (or SSL Certificate) creates an encrypted connection between a Web site and a visitor's Web browser. This link ensures that all data passed between the Web site and the browser remains private and secure.

ORDER FULFILLMENT

All orders are shipped promptly from a distributor warehouse or in-store inventory within 3 - 10 business days using UPS, FedEx, or USPS. Tracking numbers are available for items shipped via UPS and FedEx.

ONLINE PRICE & DESCRIPTION ERRORS

Online inventory changes every day. Occasionally an item may appear on the site by mistake or the item's description may contain a typographical error. We do not guarantee that titles, descriptions, pictures or prices on our site are error-free. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. In the event that we cancel an order we will not charge the customer's credit card or we will refund the money.

AMMUNITION PURCHASES

You must be 18 or older to purchase rifle or shotgun ammunition and 21 or older to purchase handgun ammunition. All ammunition will be shipped ground with adult signature required. Always make sure to use the correct ammunition for your specific firearms. Check your local laws for any other regulations.

LAYAWAY (in-store Only)

Sahuarita Guns layaway is a 60-day payment plan that 1/3 down on the total price of the item(s) per payment. The first payment will be due with the start of the layaway, final payment is due on or before the 60-day period from the start date of the layaway. Failure to pay; at any time that a payment is not received by the due date, Sahuarita Guns has the right to terminate this agreement and all monies paid will be forfeited. At Sahuarita Guns discretion, we can continue the agreement with an additional fee of 10% of the total layaway amount. Early pay off; any time the customer can pay off the remaining balance of the layaway without any additional fees.

Cancelation of Layaway; at any time, you are unable to continue to make payments for any reason you can cancel the layaway agreement. If you choose to cancel you will forfeit 1/3 of the total layaway and will not be obligated to pay the remainder of the balance.

Picking up of Item(s); When the balance is paid in full only the customer of the layaway can receive the items.

When all the payments have been made for a firearm layaway all necessary paperwork will be filled out and processed (ATF 4473). If the purchaser is unable to possess the firearm for any reason, Denied from NICS or Local Law Enforcement, Sahuarita Guns will keep the firearm(s) and will refund the customers money minus 1/3 of the total money of the layaway. If the firearm is to be shipped, it will only be shipped to an FFL dealer in their area and all previous stipulations still apply. There will be no refund on shipping charges, customer will be responsible for all transfer fees from their local FFL dealer.

CONSIGNMENTS

Consignment firearms have always required the completion of an ATF Form 4473 upon return of the firearm to the person who placed it in consignment. These firearms are placed in the licensee business inventory for sale and at that time they are entered in the licensee business acquisition and disposition record book. If the licensee does not sell the firearm, it may be returned to the unlicensed individual. At that time an appropriate entry is made in the licensee acquisition and disposition record book as a disposition from the business inventory and the ATF Form 4473 is completed. Therefore, if a consignment firearm is not sold and returned to the person who placed it into consignment, a NICS check is required. Consignor of certain (property, equipment, items) more particularly described hereinafter and Sahuarita Guns, Consignee for and in exchange of good and sufficient consideration and the mutual promises and undertakings set forth in this Consignment Agreement ("Agreement") do agree to the following:

  1. Ownership. Consignor warrants, covenants and agrees that the (property, equipment, items) being sold (is, are) owned by Consignor and that there are no liens, judgments or other encumbrances against the ownership, including all rights of sale or transfer, of the consigned (property, equipment, items).
  2. Description of Consignment. Consignor agrees to deliver and Consignee agrees to accept for the purpose of sale on the terms and conditions hereinafter recited in this Agreement, the following described (property, equipment, items). Consignor states and agrees that the description(s) of the consigned (property, equipment, items) is/are true and correct to the best of Consignor's knowledge and belief and further, that no undisclosed defects in such consignment are known to Consignor.
  3. (Non-Exclusivity or Exclusivity) of Agreement. Consignee shall have the right to market and sell the (property, equipment, items) described herein above. Consignor shall have the right to sell the (property, equipment, items) described herein above for his own account.
  4. Price. The offering price(s) (is/are) to be determined by Consignor. Consignee agrees to inform Consignor of bona fide offers to purchase the consigned (property, equipment, items) for prices less than the asking price set by Consignor. Consignor (reserves the exclusive right/grants the right to Consignee) to accept a price less than the offering price.
  5. Time of Payment(s) to Consignor. Consignor agrees that Consignee shall require and receive full payment on the sale of the consigned (property, equipment, items) prior to any obligation of Consignee to remit payment to Consignor for the same. Upon receiving full payment for such sale, Consignee shall remit, in United States currency or a check drawn on a United States bank, the amount due to Consignor under this Agreement no later than the day of the month following the date of such full payment. It is agreed that full payment shall be construed to mean and include ten (10) days for the clearing of any monetary instrument by Consignee's bank. 6. Amount(s) of Payment(s) to Consignor. Consignor and Consignee that an amount of 82% of the selling price as set and agreed to by Consignor shall be due and payable to Consignor for the sale of the (property, equipment, items) subject to this Agreement. The parties agree the Consignee may withhold and retain the commission from the amount under Article 5 of this Agreement upon the sale of the consigned (property, equipment, items).
  6. Termination of this Consignment Agreement. Consignee may terminate this Agreement at any time by returning to Consignor any or all of the unsold (property, equipment, items) which is/are the subject of this Agreement without any penalties. Consignor may terminate this Agreement at any time so long as such termination is made before the sale of (property, equipment, items) which is/are subject to this Agreement. The expense of delivery of any unsold (property, equipment, items) will be subject to a consignee fee and $35 for transfer fee. Prior notice of termination shall not be required of a terminating party.
  7. Operation of Consignee's Business. Consignee shall have the exclusive right to determine the business operation and management of its premises. Consignor shall have no liability or responsibility for the operation and management of Consignee's business, employees or agents.
  8. Advertising. Consignee may use Consignor's name or other identifying information in the advertising, promotion and sale of the consigned (property, equipment, items).
  9. Assignment. This Agreement is not assignable and may not be modified other than by a written modification agreed to and signed by both parties.
  10. Construction. This Agreement shall be construed and governed according to the laws of the State Arizona.
  11. Waiver. Waiver, forbearance, course of dealing or trade usage shall not affect the right of a party to demand performance of any term or condition of this Agreement.
